Confidentiality Policy
B&G Security Consultants Inc. provides services that include, but are not limited to: surveillance, accident investigations, collision reconstructions, missing person locates, corporate investigations, computer forensic investigative services, labor dispute management and security services.
By the nature of the business services provided B&G Security Consultants Inc. maintains a strict security and confidentiality policy relating to the collection, analysis, interpretation and distribution of proprietary, personal and confidential information. B&G Security Consultants Inc. is committed to upholding the highest ethical standards with respect to the collection and disclosure of all information gained in the course of their investigations and complies with the federal Personal Information Protection and Electronic Documents Act (PIPEDA).
All personal and business information gained or developed as a result of investigations is classified as confidential material and will be safeguarded in a manner appropriate to the level of information gained. All investigators, analysts and employees are bound by a strict code of confidentiality that includes second and third line derivatives and opinions from primary information gained or garnered on behalf of a client.
All records, including notebooks and field records, are considered original and classified documents. All materials relating to the production of a report will be held as part of the clients file and will include source notes, reliability indicators and documentation of all activities conducted during the course of an investigation on behalf of a client. Files will include notes as to all personnel exposed to all, or part of, the information therein contained.
Original source documents and reports will be held in secure storage after the conclusion of an investigation for the time periods required by either provincial or federal regulations or other guidelines.
INFORMATION MANAGEMENT
All confidential, proprietary and personal information will be collected for the purposes of an investigation under the guidelines of strictly defined terms of reference which will not be deviated from without the express permission of the client in consultation with the appropriate company case officer. Amendments to the original terms of reference for an investigation will be provided to the investigator and a copy will be placed in the case file. B&G Security Consultants Inc. will identify the purpose for which we are collecting and using personal information at or before the collection of information. Requests for information will be evaluated in compliance with the federal Personal Information Protection and Electronics Documents Act (PIPEDA). Oral explanations of the purposes for which personal information is being collected may be given and a record entered in field notes and reports.
The company will obtain consent (express or implied) prior to the collection, use, or disclosure of personal information. Information may be collected without consent in the event that collection would compromise the availability, accuracy or results of the information or on-going investigation and/or the information is required to investigate a breach of any agreement or contravention of a federal or provincial law. Consent is not required for the collection of publicly available information on an individual or company or where otherwise collected under an exception provided by either federal or provincial law.
The company will only collect information for specific and legitimate purposes under the terms of reference agreed to with the client. Modifications to existing terms of reference for an investigation will only be done as noted previously. Terms of reference for an investigation will be completed in accordance with existing federal and provincial regulations and guidelines and will not be used as an excuse to engage in unlawful and prejudicial investigative techniques. Individuals contacted during the course of an investigation will not be deceived as to the purposes of the information gathering and reporting.
Personal information collected by the company will not be used or disclosed except for the purposes authorized by the terms of reference for the investigation. Exceptions to this policy will be judged on the criteria of individual consent and requirements of law.
All information will be safeguarded in a manner appropriate to the sensitivity of the material. This will include physical measures – locked filing cabinets, restricted areas, alarm systems, password and encrypted access to computer and data retrieval systems, the use of non-networked computers for the storage of electronic media and the recovery of all working files, notes, computer files and related media from the investigators upon the conclusion of an investigation.
Upon the expiry of federal, provincial or industry mandated timelines for retention all case materials will be disposed of in an appropriate manner including shredding, deletion, media wipes and other secure techniques. Certificates of destruction will be sent to the employing agency or company that authorized the original investigation.
Individuals may make a written request for reasonable access to information collected. The company will provide reasonable access to information collected. Refusals to access will be given in writing and all requests for access will be responded to within 30 days unless otherwise required by law.
Exceptions to access can include situations where personal information regarding a third party, commercial, proprietary or confidential information may be revealed; someone’s life or security could be threatened; the information was collected without consent for the purposes relating to an investigation of a breach of an agreement or contravention of the law; the request for information is the responsibility of the instructing principal to respond to; the information is protected by solicitor-client privileges; where information was collected without consent if obtaining that consent would have jeopardized the outcome of an investigation or if the information was generated during the course of a formal dispute resolution process. |
